Former Upshur County district clerk arrested on tampering with government records charge

This comes after the sheriff's office said she was under investigation in August for accusations related to the handling of county funds.

GILMER, Texas — Former Upshur County District Clerk Nicole Hernandez was arrested Friday for accusations of tampering with government records. 

Hernandez was booked into the Upshur County Jail on one count of tampering with a government record, which is a Class A misdemeanor, the Upshur County Sheriff's Office said. 

This comes after the sheriff's office said she was under investigation in August for accusations related to the handling of county funds. 

On Friday, she was arraigned by Precinct 2 Justice of the Peace Lyle Potter and released on a $3,500 personal recognizance bond.

Upshur County District Attorney Billy Byrd contacted the sheriff's office on Aug. 29, which was the same day that Hernandez resigned as district clerk. 

Byrd asked for a criminal investigation into Hernandez’ handling of county funds. Judge Dean Fowler of the 115th District  appointed Melissa Chevalier as the new district clerk of Upshur County.
