Continuance granted in capital murder trial for man accused in 2017 shooting death of man at Tyler apartment complex

TYLER, Texas — A continuance was granted last week in the capital murder case of a Tyler man accused in the 2017 shooting death of a man at a Tyler apartment complex. 

Christopher Benard Hardy, 24 was arrested and charged with capital murder on Nov. 13, 2017.

Hardy is alleged of shooting and killing Darryl Dewayne Washington Jr. and injuring two others in a narcotics related shooting at Chelsea Creek Apartments in Tyler.

Seydadrian Montrez Brown, 26, also was arrested and indicted in the shooting, but the Smith County District Attorney's Office declined to prosecuted Brown on the capital murder charge and dismissed the charge, according to Smith County judicial records. 

Hardy was scheduled to appear in court on Monday. His trial was rescheduled for May 13, according to Smith County judicial records.
